These Terms of Use (“Terms”, “Agreement”) are a legally binding agreement between you (“User”, “you”) and BrandWorksApp LLC (“Company”, “we”) governing access to the MoneyWorks and Vela mobile apps (the “Apps”), the brandworksapp.us website (the “Site”) and related services (the “Services”).
PLEASE READ THESE TERMS CAREFULLY. By creating an account, downloading an App, purchasing a subscription, or using any part of our Services, you confirm that you have read, understood and agree to these Terms.
You must be at least 13 years old to use the Services. Users aged 13–18 may use the Services only with the consent and supervision of a parent or legal guardian. You confirm you are not barred from using the Services under the laws of your jurisdiction and will comply with all applicable laws.
When you register you agree to: provide accurate, current information; keep it updated; keep your password secure; and notify us immediately of any unauthorized access. You are fully responsible for activity under your account. We may suspend or delete an account with inaccurate data or suspicious activity. You may not transfer your account or create multiple accounts in one App.
A personal-finance tracking app: income, expenses, assets, debts, goals, 30-day dynamics. MoneyWorks is an informational tool and is NOT financial advice, an investment recommendation or tax advice.
A life-navigator app: daily advice, a day-rated calendar, personal numbers from your birth date, event planning, up to 10 profiles. Vela provides entertainment and planning content and is NOT professional advice.
If you order services from us (a website, brand, menu, photography, an app, etc.), the following applies:
Agreement. Before any work begins, we enter into a written agreement or an accepted proposal (Scope of Work) with scope, timeline, price and payment schedule. Work starts after it is signed and the deposit is paid.
Business analysis. The paid analysis ($490) is a standalone service; its fee is credited toward your project if you continue with us within 60 days.
Payment & deposit. Unless agreed otherwise — a 50% deposit to start, the balance at milestones or on delivery. Invoices in USD, payable within 7 days; late amounts may accrue 1.5% per month. Taxes and third-party costs (hosting, fonts, stock, ad spend) are billed in addition.
Revisions & client duties. Each stage includes a reasonable number of revision rounds within scope; out-of-scope work is quoted separately. You provide materials, access and approvals on time and warrant you hold the rights to anything you give us; your delays move the timeline.
Ownership. Ownership of final deliverables transfers to you upon full payment; until paid, rights remain with us. We may show the work in our portfolio and retain our pre-existing know-how, tools and any third-party/open-source components under their licenses.
Service refunds / “if you don't like it.” Services are custom. The deposit covers work already begun and is non-refundable once work starts; you pay for work actually performed. If you don't like the result, we revise within the agreed scope until it meets the brief; a change of taste or scope is not grounds for a refund.
Termination & relationship. Either party may end a project on written notice; you pay for work performed up to the termination date. We act as an independent contractor, not an employer/employee or partnership.
Free trials. MoneyWorks and Vela offer a free trial (Vela — 7 days). At the end, the subscription automatically converts to paid unless cancelled.
Price. MoneyWorks — $69.99/year. Vela — $69.99/year. Prices are in USD and may vary by country. We may change prices with 30 days' notice.
Payment processing. All payments are processed solely through the Apple App Store or Google Play. We do not collect or store card details.
Auto-renewal. Subscriptions renew automatically unless cancelled at least 24 hours before the period ends. Manage: iOS — Settings → Apple ID → Subscriptions; Android — Google Play → Payments & subscriptions → Subscriptions.
Refunds. Refunds are handled by Apple or Google. You may also contact us: info@brandworksapp.us. See the Refund Policy.
Referral program. Some Apps offer referral programs; terms are shown in-app. Abuse (fake accounts, bots) leads to disqualification and possible account removal.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes. You may not: modify, decompile or create derivative works; copy, distribute or publish content; use automated data-collection tools; use the Services commercially without written consent; or remove copyright notices. Use of the Apps is also governed by the EULA.
You may not use the Services to: break the law or others' rights; post unlawful, harmful or abusive content; impersonate others; interfere with the Services; gain unauthorized access; send spam; introduce malware; harvest user data; or place excessive load on our servers.
All intellectual-property rights in the Services belong to BrandWorksApp LLC and are protected by U.S. and international law. CLIRIUM® is a registered trademark and the proprietary methodology of Victory Naydenova. Vela and MoneyWorks are proprietary tools of BrandWorksApp LLC. You keep ownership of the content you create in the Apps (financial records, events) and grant us a limited license to use anonymized data to improve the Services.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. We do not warrant uninterrupted or error-free operation; accuracy of results; correction of all defects; or that they meet your expectations. MoneyWorks is not financial advice; Vela is not professional advice.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRANDWORKSAPP LLC, ITS MANAGING MEMBERS, EMPLOYEES AND PARTNERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES. The Company's aggregate liability will not exceed the amount you paid in the prior 12 months.
You agree to indemnify BrandWorksApp LLC, its managing members (Victory Naydenova and Vladlen Naydenov) and affiliates against all losses, claims and costs (including legal fees) arising from your use of the Services, your breach of these Terms, or your infringement of third-party rights.
We may suspend or terminate your access at any time for breach, fraud, prolonged inactivity, or as required by law. You may delete your account at any time (Account Deletion). Provisions that by their nature should survive termination remain in effect.
These Terms are governed by the laws of the State of Florida, USA. Disputes are subject to the courts of Osceola County, Florida. Before filing suit, the parties agree to attempt good-faith informal resolution for 30 days.
If any provision is held invalid, the remaining provisions stay in effect. The Company's failure to enforce a right is not a waiver of it.
These Terms, together with the Privacy Policy, EULA and Refund Policy, are the entire agreement between you and BrandWorksApp LLC. In case of conflict between language versions, the English version prevails.
We may change these Terms at any time. For material changes we will notify you via the Apps, the Site or email. Continued use of the Services means you accept the updated Terms.
